Customer Terms & Conditions

Purpose 

This page constitutes an agreement for in-flight pet transport services, hereinafter referred to as (“Agreement”) is effective immediately and subject to the terms and conditions contained within the said Agreement between the Parties and is made a part thereof.

Any term not otherwise defined herein shall have the meaning specified in the Agreement. In the event of any conflict or inconsistency between the terms and conditions concerning the business relationship between Parties, the terms of this Agreement shall govern and prevail.

This Agreement, executed between, SnubStub Pet Travel, hereinafter referred to as (“Company”) and website users and paying customers, hereinafter referred to as (“Customer”), collectively referred to as the (“Parties”)

Period of Performance

The Services shall commence on the date of this Agreement and shall continue for a period of 12 months until cancelled by the Company or the Customer, pursuant to the agreed trip details. Future additional trips requested and completed within 12 months of the date of this Agreement do not require an additional contract and will be covered hereunder.

Recitals

The Company is a Pet Courier that physically cares for pets in compliance with all federal, state, and local laws regarding permits, licensing, insurance, reporting requirements and other legal requirements of any kind that may be required to carry out said business and the Scope of Work which is to be performed pursuant to this Agreement.

Scope of Work

The Company shall provide the Services as follows:

 

Trip Request:

  • Facilitate travel quote and booking on a commercial airline and organize for pet travel companion to accompany and care for your pet.

  • Once the trip is paid, we provide a flight itinerary with drop and pick-up information.

  • Arrange to meet the customer at the airport or at a designated public place.

  • Provide a checklist of items that the customer will need to bring.

 

Pick-Up:

  • On time arrival to meet customer at the airport no less than 1 hour before boarding.

  • Introduction to customer for intake assessment and consultation.

  • Provide an overview of what to expect and how frequently you will receive updates.

  • Introduction to your pet to start the bonding process to comfort for your pet.

  • Inspection of customer’s pet and pet carrier to ensure it is approved by airline policy.

  • Retrieval and review of pet’s health certificate and vaccination records.

  • Signature of Customer confirming pick-up (once mobile app is deployed).

In Transit (at airport and/or in-flight):

  • Offer food (if provided) and water to the pet before and after flight.

  • Offer restroom breaks with pee pads (if provided) at the pet relief area or private restroom.

  • Offer as much exercise as possible (e.g., by walking the dog instead of carrying it)

  • Ensure harness and leash are properly secured before carrying the pet through TSA security.

  • Ensure the pet is safely secured inside the pet carrier for take-off and landing.

  • Check with flight crew to determine if keeping the pet out of the carrier will be tolerated.

  • Keep the area around the carrier clear to provide maximum airflow and comfort.

Drop-Off:

  • Introduction to customer and facilitate introduction of pet to customer.

  • Inspection of customer’s ID or request verbal password before transferring pet.

  • Transfer of pet’s health certificate and vaccination records.

  • Provide a short verbal summary of what happened during the trip (food, restroom, etc.).

  • Signature of Customer confirming drop-off (once mobile app is deployed).

Customer Responsibilities

As Customer, you agreed to the following:

 

Trip Request:

  • Provide all necessary information to facilitate booking and travel arrangements.

 

Trip Preparation:

  • Provide signed Customer Agreement, vaccination records, health certificate and recent photo of the traveling pet

  • Provide an airline approved soft-sided carrier that is approved by airline policy.

  • Provide small zip lock bag of dry food.

  • Provide a comfortable harness and leash.

 

Pick-Up:

  • On time arrival to meet travel companion at the airport which is no less than 1 hour prior to boarding time. Otherwise, additional fees will apply.

  • Provide physical copies of necessary documentation (health certificate, vaccine records, etc.)

 

In-Transit (at airport and/or in-flight):

  • Be available to accept communications (text, email, phone, etc.)

  • Acknowledge that air travel may result in uncontrollable delays and/or cancellations. In the event that your airline substantially delays or cancels your pet’s flights, the Company reserves the right to cancel the trip, make modifications or return to the airport to pick up your pet.

 

Drop-Off:

  • On time arrival to meet travel companion at the airport which is no less than 1 hour prior to arrival time. Otherwise, additional fees will apply.

  • Show ID or provide verbal password before accepting pet.

  • Provide signature confirming pet acceptance.

 

Additional Expense Schedule

This Agreement specifies additional charges based on the following events:

​

  • Late Arrival for Drop-Off or Pick-Up (More than 30 mins) is charged at a rate of $50 per hour

  • Late Arrival for Drop-Off (More than 1 hour) is charged at a rate of $50 per hour and trip will be considered no-show and travel companion will leave.

  • Airline delay of 2 hours to 4 hours at departure or connecting airport is a flat rate of $100

  • Airline delay of greater than 4 hours to 24 hours and/or flight cancellation by airline will require temporary accommodation, meal and ground transportation which will be billed at cost. 

  • Airline delay of greater than 24 hours will require a new booking and fee or trip cancellation at the sole discretion of the Company.

  • Emergency medical care for your pet, if deemed necessary at the sole discretion of the Company, Your pet will be taken to the nearest animal emergency service provider and will billed at actual costs and incur a flat $50/hour until human travel companion is relieved by you or your emergency contact. 

  • Late Arrival for Pick-Up (More than 1 hour) is charged at a rate of $50 per hour and use resonable means to return the pet to sender which is billed at actual costs. 

  • Late Arrival (More than 1 hour & Sender not in same city) is charged at a rate of $50 per hour and and use resonable means to transport the pet to alternative address of emergency contact person or nearest pet boarding facility if emergency contact is not reachable after 1 hour, based on sole discretion of the Company. If pet boarding facility is used, Customer agrees to have thier credit card information shared to as responsible party.

Notice Concerning Applicable Laws

Customer recognizes and agrees to abide by all federal, state, and local laws as well as airline and company policies. If violation will result in contact of appropriate authorities and the trip will be cancelled without refund.

 

Refund Policy

Upon written notice, within 48 hours of paying the invoice, the Customer will be reimbursed 100% of the trip amount. After such time, there are no refunds and sales are final.

 

 

Customer Conduct and Behavior

This Agreement may be immediately terminated without refund by the Company for any reason, but not limited to the following examples:

  1. Soliciting or attempting to solicit any workers of the Company.

  2. Paying or attempting to pay any workers of the Company for any services.

  3. Use of profanity or unprofessional language, tone or volume as deemed by the sole discretion of the Company.

  4. No Shows or Being Late for any trip.

 

Insurance and Limitation of Liability

Customer agrees to Company that the value of the pet is equivalent to its purchase price. In the rare event, that a pet is lost or dies as a direct consequence of the actions of the Company, the Company’s insurance provided will be contacted and the Customer will deal directly with the insurance company.

In the event of a pet’s death to the direct consequences of the Company, the Company’s liability is limited to the purchase price of the pet, up to a maximum of $3,000. In the event, a pet contracts an illness or is injured a direct consequence, the Company’s liability for veterinarian fees and approved treatments, up to a maximum of $500.

 

Indemnification

The Customer shall defend, indemnify, hold harmless Company from any and all damages expenses or liability resulting from or arising out of, any negligence or misconduct or dishonesty of our employees or Independent Contractors, or from any breach or default of this Agreement which is caused or occasioned by the acts of Employees or Independent Contractors.

 

Confidentiality and Non-Disclosure

Customer agrees not to disclose or communicate, in any manner, either during or after Customer’s agreement with Company, proprietary information about Company, hereinafter referred to as “Information”, its operations, clientele, or any other proprietary information, that relate to the business of Company including, but not limited to, the names of its employees and independent contractors, its marketing strategies, operations, or any other information of any kind which would be deemed confidential, a trade secret, a customer list, a prospect list, exercise methods, programs, processes, unpublished materials, products, trademarked assets, additional programs and offerings to be added and all other information included in the scope of the Customer acknowledges that the above Information is material and confidential and that it affects the profitability of Company. Customer understands that any breach of this provision, or that of any other Confidentiality and Non-Disclosure Agreement, is a material breach of this Agreement. “Current business of the Company” shall be defined as employees and independent contractors who have active agreements at Company’s pet services, customers who have possessed past agreements with the Company, and potential customers.

Customers shall not reveal to any third party, without written consent of Company, any improvements, discoveries, developments, inventions, processes, methods, plans, customer listing, customer status or files, pricing, confidential affairs, or any other matters, the revealing of which could, in any manner, adversely affect the Company’s Business. In addition, Customer shall not take any action which might reasonably or foreseeable be expected to compromise the confidentiality or proprietary nature of any Confidential Information. Company wishes to disclose the Information only if it can do so without risk that the Information’s value will be diminished. Customer understands that Company has invested substantial effort into developing this Information and that Customer’s unauthorized disclosure of the Information would irreparably damage Company. The Information cannot be adapted, renamed, or reengineered in any manner to create, teach, or offer a similar program, routine, or service.

Non-Solicitation Covenant

Customer will not, during this Agreement and for a period of ten years immediately following termination of this Agreement, either directly or indirectly, call on, solicit, or take away, or attempt to call on, solicit, or take away, any of the employees, contractors or clients provided by the Company, whether or not Customer worked with or spoke to during the course of this Agreement for pet services and consultation, either for their own benefit, or for the benefit of any other person, firm, corporation, or organization.

 

Non-Recruit Covenant

Customer will not, during this Agreement and for a period of ten years immediately following termination of this agreement, either directly or indirectly, on behalf of himself or on behalf of any other person, firm, or corporation, solicit or recruit any employee or contractor of the company to leave the employ of the company or to become employed by any person, firm or corporation engaged in competition with the company.

Governing Law

This Agreement shall be governed by, and construed under, the laws of the State of Texas.

It is the intention of the Company that the provisions of this Agreement shall be fully enforced permissible under the laws and public policies of the State of Texas. I

f any provision of this Agreement shall be determined to be invalid or unenforceable, either in whole or in part, this Agreement shall be deemed amended to delete or modify, as necessary, the offending provisions and to alter the balance of this Agreement in order to render the same valid and enforceable to the fullest extent permissible.

Additionally, the provisions of this Agreement shall be deemed to be valid for any lesser duration permitted by law if the duration set forth herein is deemed to be too broad by a court of competent jurisdiction. This Agreement shall be in full force and effect for 10 years, commencing with the date of employment termination. This Agreement shall be binding upon and inure to the benefit of the parties, their successors, assigns, and personal representatives.
